Terms of Service

These terms cover use of edgutentag.com and engagement of services from ED Gutentag Photography (Edward A. Gutentag, sole proprietor, Panama City Beach, Florida). Plain English version below — formal contract terms apply to engaged projects via a separate signed agreement.

1. Use of the website

This site is provided as-is for informational purposes. The content (text, images, video, embedded media) is owned by ED Gutentag Photography unless otherwise credited. You may share links to pages on this site freely. You may not reproduce, modify, or republish the imagery or copy without written permission.

2. Engagements

Photography, cinematography, drone, Matterport, wedding, and portrait engagements are governed by the project agreement signed at the time of booking. The website's pricing posture, packages, and timelines are indicative — every project is quoted on its specific brief.

3. Drone work + FAA compliance

All aerial work is conducted in accordance with FAA Small Unmanned Aircraft Systems regulations (14 CFR Part 107). FAA Part 107 certification is currently pending; until certified, drone operations are limited to those permitted under applicable hobbyist or other lawful authorisations, and we will not undertake commercial work that requires Part 107 certification we do not yet hold. We coordinate LAANC airspace authorisations where required and operate within applicable altitude, distance, and operational restrictions.

4. Image licensing & usage

Default delivery for commissioned work includes a usage license appropriate to the project type. Real estate listings get marketing-use rights for the duration of the listing. Wedding and portrait clients get personal-use rights. Commercial and brand work is quoted with specific usage rights spelled out in the project agreement.

Buying a print from edgutentag.shop grants personal display rights for the purchased piece; resale and reproduction rights are not transferred.

5. Cancellation & rescheduling

Specific cancellation, deposit, and rescheduling terms appear in each project agreement. Weather-related rescheduling for outdoor and drone shoots is handled by mutual agreement — coastal Florida weather is a known variable.

6. Limitation of liability

To the maximum extent permitted by Florida law, ED Gutentag Photography's liability on any engagement is limited to the fees paid for that engagement. Standard professional indemnity and equipment insurance is in place.

7. Governing law

These terms and any engagement are governed by the laws of the State of Florida. Disputes are subject to the exclusive jurisdiction of the courts located in Bay County, Florida.
